TERMS AND CONDITIONS FOR PARTICIPATING IN
PIERS PARK SAILING CENTER ACTIVITIES:

In consideration of use of the property, facilities and/or services of the Piers Park Sailing Center, Inc. (PPSC) and the Massachusetts Port Authority (Massport) I agree as follows:

RISK FACTORS. I understand and acknowledge that sailing and related activity with PPSC involves various physical risks such as risk of injury, property damage and/or loss of life.
ASSUMPTION OF THE RISK. I assume any and all risk arising from any and all of my activities at or with PPSC and its personnel.
ACKNOWLEDGEMENT OF POLICIES AND PROCEDURES. I acknowledge that I have been given a copy of, and have read and understand, all of the policies and procedures governing my activities at PPSC. I understand that I am required to abide by such policies and procedures while at PPSC or participating in any PPSC activity.. I understand that under emergency conditions, I am required to follow set procedures and any directives of the staff of PPSC.
PREREQUISTE SKILLS AND TRAINING. I acknowledge that I have the requisite skills, qualifications and training necessary to properly and safely participate in activities of PPSC. If I have any questions as to what skills, qualifications or training are necessary for my participation, I will direct these questions to the appropriate person supervising the activity and abide by all decisions of staff members, including those decisions that result in my not being permitted to participate in a specific activity because of a lack of training, qualifications or specific skills. All such decisions of PPSC staff are final.
RELEASE. I release Piers Park Sailing Center, Inc., the Massachusetts Port Authority and all of the PPSC and MassPort officers, directors, trustees, employees and agents, and I agree not to sue them in conjunction with any claims arising out of my participation in PPSC activities.
WAIVER. I waive any unknown future claims which may arise due to my participation in PPSC activities.
INDEMNIFY AND DEFEND. I indemnify and defend Piers Park Sailing Center, Inc., the Massachusetts Port Authority and their officers, directors, trustees, employees and agents against, and hold them harmless from, any and all claims, including attorney fees, which may arise from my participation in PPSC activities, whether or not these claims arise from my own actions or those of anyone else.
SWIMMING CERTIFICATION. I certify that I am capable of swimming 50 yards and able to tread water for 5 minutes. Adaptive sailors must certify they can form a seal with their mouth; otherwise a special life vest must be worn.
EMERGENCY TREATMENT CONSENT. I am an adult of 18 years or older. As a participant in Piers Park Sailing Center activities I hereby consent to medical treatment in an emergency when I am unable to consent to treatment.
RESPONSIBILITY FOR GUESTS. I agree that I am responsible for the safety and behavior of all guests who sail with me. I will inform them of all appropriate policies, procedures, rules and regulations of PPSC. I will be responsible for any of their actions, including those that cause damage or injury to PPSC, Massport, or others.
DAMAGE WAIVER: As a member of Piers Park Sailing Center, I am accountable for all losses and any damage to equipment owned, borrowed or leased by PPSC, which is used by me or my guests. I agree to pay for up to the limit of PPSC’s insurance deductible ($500) for loss or damage to equipment in my care per incident and to pay the full cost for any damages not covered by PPSC’s insurance.
PROGRAM INTERRUPTIONS. Program operations may be interrupted due to storms, fires, other acts of God, or circumstances beyond the control of PPSC. I understand that I must comply with all such operational disruptions and further understand that PPSC reserves the right to make fee adjustments at its sole discretion, subject to the ability to recover damages.
REPRESENTATIVES. I enter into this agreement for myself, or on behalf of another for whom I am legally responsible.
ACKNOWLEDGEMENT. I have read and understand this agreement. I realize it relates to accepting liabilities and releasing valuable legal rights. I do so freely and voluntarily
